Retiring Arizona Prison Watch...


This site was originally started in July 2009 as an independent endeavor to monitor conditions in Arizona's criminal justice system, as well as offer some critical analysis of the prison industrial complex from a prison abolitionist/anarchist's perspective. It was begun in the aftermath of the death of Marcia Powell, a 48 year old AZ state prisoner who was left in an outdoor cage in the desert sun for over four hours while on a 10-minute suicide watch. That was at ASPC-Perryville, in Goodyear, AZ, in May 2009.

Marcia, a seriously mentally ill woman with a meth habit sentenced to the minimum mandatory 27 months in prison for prostitution was already deemed by society as disposable. She was therefore easily ignored by numerous prison officers as she pleaded for water and relief from the sun for four hours. She was ultimately found collapsed in her own feces, with second degree burns on her body, her organs failing, and her body exceeding the 108 degrees the thermometer would record. 16 officers and staff were disciplined for her death, but no one was ever prosecuted for her homicide. Marcia's death and this blog compelled me to work for the next 5 1/2 years to document and challenge the prison industrial complex in AZ, most specifically as manifested in the Arizona Department of Corrections. I corresponded with over 1,000 prisoners in that time, as well as many of their loved ones, offering all what resources I could find for fighting the AZ DOC themselves - most regarding their health or matters of personal safety.

I also began to work with the survivors of prison violence, as I often heard from the loved ones of the dead, and learned their stories. During that time I memorialized the Ghosts of Jan Brewer - state prisoners under her regime who were lost to neglect, suicide or violence - across the city's sidewalks in large chalk murals. Some of that art is here.

In November 2014 I left Phoenix abruptly to care for my family. By early 2015 I was no longer keeping up this blog site, save occasional posts about a young prisoner in solitary confinement in Arpaio's jail. I'm deeply grateful to the prisoners who educated, confided in, and encouraged me throughout the years I did this work. My life has been made all the more rich and meaningful by their engagement.

Brown Shirts in the House and the Tea Party Senate.

This little tidbit about our own Tea Party Senate President-Elect, Russ Pearce, comes as no surprise to those of us who know and love him. Thank god Tancredo lost Colorado, by the way - at least there's one piece of good news coming out of the elections last week. JT Ready and his kin have a lot to celebrate in Arizona this year, though. The National Socialist Movement is coming back to the Capitol in Phoenix on Saturday November 13th, I hear - they'll be at the Federal Courthouse at 1pm for their rally and march...well protected by the boys in blue, I'm sure.

I may be too tied up with the real Fascists here to go out and play with them, myself, though. They all strike me as little bullies playing dress-up. Not that they're harmless - remember the River City Pool Hall Murder and other violence when Unit 88 was running amok here. Those are the kinds of thugs we should be keeping a close eye on for signs of trouble - not sidewalk chalkers and anarchists (both the neo-nazis and the good Senator...)

Candidates Tied to White Nationalism Gain Ground in 2010 Elections

With 96 members as of 2010, the House Immigration Reform Caucus [1] (IRC) was founded by Tom Tancredo, a xenophobic politician from Colorado who passed the reigns to Brian Bilbray of California, another politician fiercely hostile to immigrants, after an ill-fated run for President in 2007. Bilbray is a former lobbyist [1] for the Federation for American Immigration Reform [2], an organization which is listed as a hate group [3] by the Southern Poverty Law Center for its ties to white nationalists.

Tom Tancredo’s run for governor of Colorado in 2010 was unsuccessful as well. He lost by a 13% margin to Denver Mayor John Hickenlooper. Bilbray (incumbent) won the California Congressional District 50 House Seat with 59% of the vote. All members of the IRC are incumbents of their Congressional Districts and most have been re-elected for another term. These include Rep. Steve King (IA-5, 66%), Rep. Louie Gohmert (TX-1, unopposed), Eric Cantor (VA-7, 59%), Vern Buchanan (FL-13, 69%), Michele Bachmann (MN-6, 50%).

Losses include Parker Griffith (AL-5, defeated in primary) and Lincoln Davis (TN-5, 38%).

State Legislators for Legal Immigration [4] (SLLI) is a coalition founded by Pennsylvania Rep. Darryl Metcalfe. SLLI which is the legislative arm of Federation for American Immigration Reform (FAIR) works closely with the Immigration Reform Law Institute [5], the legal arm of FAIR, to pass punitive immigration laws at the state level. Almost 50 members of SLLI – out of 70 – were up for reelection in 2010, a good number of which ran unopposed. A majority of SLLI members will be back for another term.



A well-known member of SLLI is Arizona State Senator Russell Pearce [6] (AZ-18). Pearce gained notoriety for being the public face of the controversial Senate Bill 1070, and is now spearheading attacks on the 14th Amendment. Pearce’s is openly tied to neo-Nazis in Arizona. This [7] is a picture of Pearce in 2007 with a man named J.T. Ready. According to the Southern Poverty Law Center, J.T. Ready is a neo-Nazi leader in the National Socialist Movement.

IRC and SLLI, two groups with hostile views towards immigrants, have been flirting with white nationalists for too long. These election results show that voters are either unaware of this fact or indifferent to it, and that needs to change. This is not the time to bury our heads in the sand (like the ostrich) while white nationalists shape the debate around immigration. It’s time to get educated and proactive in the fight against xenophobia.

Candidates to Vote Down: The Pearce Endorsements

Pulling this post up from an August email I received from Russ Pearce, announcing his favorite primary candidates. I think I got dropped off his mailing list after this, since I didn't get any updates. Anyway, if you love liberty and justice, don't vote for any of his recommended people. And don't vote for him!

Here's the latest from the Russell Pearce Campaign. Anyone who embraces that man's endorsements right now should be considered by the People to be armed and dangerous and not to be trusted with our tax dollars, much less our laws, lives and liberties. Those who voted for SB 1070 despite not supporting it fully are just as bad, if not worse. They voted from a place of fear, rather than their value base.
That means they can't be trusted even if they sound like they might be enlightened.

Note how many of the candidates he endorses have issues with their "constitutionals". That should tell us something. Also note the line of BS he spews about lefty "special interests" (like the poor, the hungry, undocumented immigrants, and peace activists, I suppose?) having "deeper pockets" than his crowd. He feeds that to his own people, you know. They have no idea what the truth is anymore. Perhaps they don't really care.

We've seen your money, Pearce, and we know that your strategy has always been to win by having the biggest bankroll and excluding your opposition from running or even voting in the primaries - it has certainly not been by building a constituency that's authentically dedicated to true democracy. Real Republicans like my grandfather would be ashamed to be seen in the same party with the likes of you - too bad so many of the brave ones are now dead, and the cowards are in hiding, fearing for their political lives.

A Conservative Call To Arms!
Our State Legislative Races


Every two years, self-described moderates, open-border groups, and liberal big-spending interest groups join together to raise a lot of money to support center-left candidates for legislative office. Recently, one big fundraising event raised a reported $275,000 for a group of 12 Republican and Democrat candidates. The fact that these Republicans and Democrats were similar enough in their ideology and records that they were willing to campaign together, or that donors found them all equally attractive, is a serious warning about how far left they will go if elected or re-elected. So this handy list has been prepared to help conservatives all over Arizona learn about conservatives running in key races. We have also included their mailing addresses and committee names so that you can make your own contributions. While our pockets are not as deep as the special interests we are up against, we have the advantage of numbers. Get involved, as donors or volunteers, and let’s keep our Arizona State Legislature conservative!

The profit motive, private prisons, criminalization and immigration

This is a good article making the rounds among my friends and comrades, so I decided to share it here. It's timely in light of the public hearings on prison privatization.

This is why we must be wary of doling out prison sentences and criminalizing whole classes of people - there is often an "invisible hand" at work behind the creation of new laws and the privatization of criminal justice system functions.

Even Israel's high court outlawed the private prison industry last year, as the profit motive from corporations like CCA and the GEO Group will always trump prisoner needs and human rights.
So far, Americans are still more than willing to sacrifice people for the right to profit off of storing our living, breathing bodies - and those of our children. I find that rather disturbing.

Following the Money

Over the past four years roughly a million immigrants have been incarcerated in dangerous detention facilities in our taxpayer-financed private prison system. A growing number of news reports and investigations confirm that for many of the people funneled into this system, it is a living nightmare. Children were abused, women were raped, and men died from lack of basic medical attention.

These facilities are run by two Wall Street-backed companies that actively promote the criminalization and incarceration of immigrants in the United States -the Corrections Corporation of America (CCA) and the GEO Group.

The T. Don Hutto immigrant detention facility in Taylor, Texas provides a now well-known example of the abuses that take place within private prisons for immigrants. Beginning in May 2006,the Don Hutto prison was used to house children and their parents who were on a path to deportation. Reports began to surface of widespread abusive treatment of immigrant children by staff of Corrections Corporation of America. An ACLU lawsuit filed on the basis of documented cases of abuse finally led to the closing of the Don Hutto facility for housing families in 2008. After the children were excluded, the Don Hutto only held women detainees. But the abuses continued. Evidence has surfaced that a number of women were sexually abused over the past two years in Don Hutto by CCA staff. Sexual abuse, including rape, has been documented in several detention centers.

The other large private prison corporation contracted by the federal government to run immigrant prisons is the GEO Group. The GEO detention facilities have also racked up many reports and complaints of abusive treatment of immigrant detainees and corrupt staff practices that violate the basic human rights of prisoners. Last month we spoke with the sibling of a detainee in a GEO-run facility who was denied basic medical attention for lack of funds to pay. The detainee’s family had to raise funds to get their relative medical attention in the facility from GEO. Other GEO detainees have died from a lack of medical attention.

Another relative of a GEO detainee told us that prisoners who avoid getting on the wrong side of GEO guards could aspire, at most, to a job in the prison that pays 17 cents an hour for doing office work.

GEO recently agreed to pay restitution for its employees’ physical abuse of prisoners who were strip searched in Pennsylvania, Illinois, Texas, and New Mexico. In another case, GEO was ordered to pay $40 million in the wrongful death of a prisoner in its custody in Raymondville, Texas. GEO has also been sued by seven children who were sexually assaulted by a guard while being held in a GEO facility.

Corrections Corporation of America (CCA), based in Nashville, Tennessee, and the GEO Group, a global corporation based in Boca Raton, Florida are the nation’s two largest prison companies. They run highly integrated operations to design, build, finance and operate prisons. GEO rakes in $1.17 billion in annual revenue, and CCA tops that at $1.69 billion. Together these companies are principal moving forces in the behind-the-scenes organization of the current wave of anti-immigrant legislative efforts, which, if successful, would dramatically increase the number of immigrant prisoners in over 20 states.

Following the Money

GEO CEO, George Zoley, was a Bush “Pioneer” who bundled more than $100,000 in contributions for the Bush-Cheney campaigns in 2000 and 2004. In October 2003, GEO was successful in securing the contract to run the Guantánamo Bay Detention Camp, in Guantanamo Bay, Cuba.

GEO hired the services of lobbyists who had held influential positions in the U.S. Department of Homeland Security, Bureau of Prisons, Office of the Attorney General, and the office of then-Senate Majority Leader, George Mitchell, to lobby their former employers and Congress. Throughout 2005 and leading up to the largest immigration raid in U.S. history in December 2006, GEO and CCA spent a combined total of over $6 million on lobbying efforts.

On May 1, 2006, while millions of people marched in favor of immigrant rights in 102 cities across the country, GEO and CCA were lobbying the federal government for more business. The marchers, despite their historic turnout and broad citizen base, could not block the growing wave of government support of GEO’s and CCA’s business plans.

The December 2006 raid, in which over a thousand men and women employed at Swift meat-packing plants in several states were detained, marked a change in the federal government’s enforcement of the 1995 immigration law. For the first time, many of those picked up were charged with crimes such as falsifying identity documents or identity theft that carry long prison sentences, rather than misuse of a social security number, a misdemeanor.

This single change in enforcement of existing law created a potential “market” of over 10 million new felons almost overnight, multiplying the lucrative incarceration market for the private prison industry and sending a shock wave through immigrant-related communities across the country. At the time of the Swift raid, USA Today quoted the Reverend Clarence Sandoval of St. Thomas Aquinas Catholic Church in Logan, Utah, as saying, “They are taking mothers and fathers and we’re really concerned about the children. I’m getting calls from mothers saying they don’t know where their husband was taken.”

Through this change in how federal law is enforced, CCA and GEO suddenly had a huge pool of captive clients, and began to rake in millions of dollars in public funds to house, transport, feed and control immigrants.

Predictably, costs to taxpayers skyrocketed. From 2006 to the present, the Immigration and Customs Enforcement Agency (ICE) budget for the identification, custody, transportation, detention and removal of immigrants has increased 51%. The U.S. Marshall budget for the custody and transportation of immigrants over the same period has increased 15%, and the Bureau of Prisons budget for detention of immigrants over the same period has gone up 9%. The billions of dollars in increased expenditures have provided the primary source for the billions in increased revenue for CCA and GEO.

In addition, currently 625 state, county and municipality law enforcement agencies are providing identification, custody, transportation and detention of immigrants through agreements with the U.S. Department of Homeland Security.

According to a federal Government Accounting Office study conducted last year the cost of this program to local taxpayers is unknown because 60% of state and local governments do not keep data on their personnel, equipment, supplies and other costs related to these agreements, and therefore are not reimbursed for those costs. Whatever the exact cost, local taxpayers will feel the pinch as this program is expected to expand to all 3,100 state, county and municipal detention jurisdictions in the nation by the end of 2011. Consequently CCA and GEO can expect to increase their revenues as states and counties increasingly subcontract incarceration responsibilities to these companies.

Last year Seeking Alpha, a website of actionable stock market opinion and analysis popular on Wall Street, reported that GEO’s income from prison health care services ending in March of 2009 topped $1.0 billion, a 5.8% profit. Seeking Alpha also stated that CCA’s profit for the same period in 19 states was over $1.6 billion, with a profit margin of 9.4%. In an article entitled “Where Delinquencies Make for Good Business” the same publication noted, “Crime, unfortunately, is a growth industry and GEO Group has proven to be a successful player in the outsourcing trend for governments at many levels.” Pushing criminalization of immigrants to cast a wider net in society has been a key part of that “success.”

Soon after the Bush Administration implemented the change in law enforcement affecting immigrants, Wall Street advisors publically recommended buying stock in private prison companies like CCA and GEO. At the time, Vice President Dick Cheney was heavily invested in Vanguard, one of a handful of major shareholders in GEO.

The lobbying paid off for both companies, in huge revenue increases from government contracts to incarcerate immigrants. From 2005 through 2009, for every dollar that GEO spent lobbying the government, the company received a $662 return in taxpayer-funded contracts, for a total of $996.7 million. CCA received a $34 return in taxpayer-funded contracts for every dollar spent on lobbying the federal government, for a total of $330.4 million. In addition, both companies increased revenues over the same period from detention facility contracts with a number of states.

In 2007, the Immigration and Customs Enforcement Agency (ICE) conducted 30,407 immigration raids in workplaces, neighborhoods, and public gathering sites such as bus stops and commuter train platforms. The number of raids conducted that year was double the 2006 total. The number of immigrants placed behind bars, for what amounts to the crime of having been born in the wrong place, increased from 256,842 in 2006 to 311,169 in 2007.

As a result of fear induced by the raids and other factors, pro-immigrant May Day marches in 2007 were much smaller than those of the previous year. In mid-2007, while many activists and organizers were focused on legislative reform, public protests, eliminating the raids, and trying to help families and friends of those who had been taken away by ICE and other enforcement agencies, GEO and CCA shareholders reaped a huge profit. Both companies issued 2-for-1 stock splits that roughly doubled the value of their shareholders’ stake.

Although stockholders profited handsomely as revenues from prison contracts rose for both companies, the increase wasn’t large enough to satisfy some of their respective major shareholders. J.P. Morgan Chase, a major owner of GEO, dumped most of its stock and relinquished its leadership position in the company.

One problem for major investors seeking huge gains from the for-profit prison business was that revenue rates couldn’t keep rising because federal agencies didn’t have enough personnel to arrest and process more immigrants than the expanded number they were now handling. It became apparent that the only way to significantly raise revenue through increasing the numbers of people picked up, detained and incarcerated was to hire more law enforcement personnel.

The private prison industry now needed a new source of low-cost licensed law enforcement personnel. CCA and GEO then turned to state governments as the focus of business expansion. Both companies stepped up efforts to acquire contracts with state and local governments that were entering into lucrative agreements with the Department of Homeland Security to detain immigrants in state and local detention and correctional facilities.

The result of this shift in business focus is exemplified by CCA’s role in Arizona’s SB 1070 and both CCA’s and GEO’s roles in other legislative efforts aimed at dramatically increased numbers arrests of undocumented immigrants in over 20 states. Arizona’s Governor Jan Brewer, who received substantial campaign financing from top CCA executives in Tennessee and employs two former CCA lobbyists Chuck Coughlin and Paul Sensman, as top aides, signed SB 1070 into law on April 23.

On Friday, July 30, 2010 the Republican Governors Association, which so far this year has received over $160,000 in contributions from CCA and GEO, and their respective lobbyists, sent out a nationwide solicitation written by Arizona Governor Jan Brewer requesting contributions to fund an appeal of the partial injunction issued by a judge against SB 1070.

In addition to funds raised by the partisan appeal, Brewer’s legal effort has been bolstered by supporting briefs filed with the appeals court by three states– Florida, Texas and Virginia–that have contracts with GEO or with both GEO and CCA. The two prison companies are currently ramping up their political involvement in these states and in several others that have anti-immigrant bills moving through their respective legislatures. In all, twenty states are considering SB 1070-inspired bills, which have been endorsed by their respective Republican gubernatorial candidates, financed in large part by the Republican Governor’s Association.

Last November, CCA’s top management in Tennessee contributed the largest block of out-of-state campaign contributions received by Arizona Governor Jan Brewer.[1] CCA, which already has several detention facilities in Arizona and hopes of expanding its immigrant prison business in that state, is expected to gain a huge increase in revenues with the implementation of SB 1070. Currently, Latinos driving out of the city of Tucson in any direction are being stopped at checkpoints, where they are asked to show their papers.

GEO and CCA are now heavily involved in the governor and state legislative races in states where they plan to expand their respective shares of the prison and incarceration market. GEO, for example, backed first-term Republican Governor, Bob McDonnell, in Virginia last year, and has contributed heavily to the Republican Governor’s Association and to the Florida Republican Party. In addition to Jan Brewer in Arizona, CCA is contributing to the campaigns of both, Republican Meg Whitman, and Democrat Jerry Brown, for governor in California. CCA is also giving money to Louisiana Governor Bobby Jindal, even though Jindal isn’t currently facing an election, and to the Republican Governors Association, which has contributed over $1.5 million to state races this year.[2]

Since the change of administration in Washington D.C., GEO has expanded its presence there by adding the services of lobbyists who formerly served in high positions in the Obama presidential campaign, the Clinton White House, and the Senate and House Appropriations committees. Currently, GEO retains the services of three Washington D.C. lobbyists who also work for Wells Fargo, GEO’s top shareholder. One of GEO’s Washington D.C. lobbyists, Barbara Comstock, is also a member of the Virginia state legislature. CCA relies on its officers to do its lobbying in Washington DC,[3] where some board members, such as former Arizona U.S. Senator Dennis DeConcini, are well-connected.

CCA’s and GEO’s share of the taxpayer-funded immigrant incarceration business has grown substantially since 2006. Today, for example, in California, anyone picked up by ICE in Los Angeles is sent to a CCA facility in San Diego, while those picked up by ICE in Seattle or Portland, OR, are sent to a GEO facility in Tacoma, Washington, because detention facilities owned and operated by the federal government are at 137% capacity, with no room to house more prisoners.

Wall Street’s Role

CCA and GEO are owned by major Wall Street institutions, which profit from the immigrant incarceration business as major shareholders.

The most influential investor in CCA is a hedge fund, Pershing Square, which is run by Wall Street investment guru activist investor, Bill Ackman. Ackman also plays a powerful role in Target Corporation and Kraft Foods. Wells Fargo is the most powerful investor in GEO.

Other major investors with the power to influence management in one or the other of the two companies are Vanguard, Lazard, Scopia, Wellington Management, FMR (Fidelity), BlackRock and Bank of America. Each of these major owners is sensitive to public opinion in one way or another. These major investors do not need to rely on either CCA or GEO to make money, since most of their money is invested in enterprises unrelated to private prisons.

By almost any measure, the increased number of deportations of immigrants has not had the desired effects on anyone other than the private prison industry. Unemployment among native-born citizens in the U.S. has skyrocketed as the number of immigrants being deported has risen to over 400,000 a year.

The United States now has more people in prison than any other country on earth. At over 2 million, the U.S. has a half million more people behind bars than China, which has the second highest number of prisoners.

One would like to think that bringing this information to Congress’s attention would be enough to compel them to abandon policies that criminalize immigrants. However, that is not likely to happen soon.

This probable reluctance on the part of Congress to act isn’t merely because of the substantial campaign contributions that Senators and members of Congress receive from the private prison industry. Most members of Congress have personal investments in one or more of CCA’s or GEO’s major shareholders.

While it is true that many people are invested in CCA or GEO through their pensions without knowing it, reports on the personal finances of some key members of Congress suggest some of them have more than a casual interest in the fortunes of CCA or GEO.

One example of a Washington DC powerhouse with a substantial financial interest in CCA is Wyoming Senator Mike Enzi, one of a small group of investors in Pershing Square, a hedge fund that holds the most stock in CCA of any of the company’s shareholders. Senator Enzi, a senior Republican who sits on the Senate Budget Committee, was awarded a 100% approval rating by U.S. Border Control (USBC), which describes itself as “a non-profit, tax-exempt, citizen’s lobby. USBC is dedicated to ending illegal immigration by securing our nation’s borders and reforming our immigration policies.”

As Congress is currently tasked with finding ways to reduce the burgeoning deficit and alleviate the suffering caused by the economic crisis, shifting priorities from programs that benefit prison companies to much-needed programs that benefit taxpayers only makes sense. Compelling Congress to abandon immigrant criminalization policies is probably going to require, among other things, that citizens convince some combination of our pension funds, Wells Fargo, and a key hedge fund or two, to pull out of the private prison industry and to go elsewhere to make money.

We should be able accomplish this. IBM and Ford, when challenged, found themselves unable to justify their investments in apartheid in South Africa. As a result of a swelling movement of students, faith-based organizations, unions and shareholders, these companies divested in 1986, contributing to the fall of the racist apartheid system and a transition to democracy.

Similarly, Wells Fargo, Pershing Square, and other financial giants shall be hard-pressed to justify investments in the massive suffering caused by the criminalization of immigrants, as a movement comes together to expose the harm done to the public good by their current investments in the immigrant prison industry.

Who knows? Some of these financial institutions might even see the wisdom in investing in companies that produce family-wage jobs.

Private Prisons in Arizona: Frank Smith v. CCA

And he wins! Of course, I'm biased. Not only am I an abolitionist, but I love this guy - Frank is my comrade and friend, fighting prison privatization for something like 20 years. He genuinely cares about what happens to communities that fall for the industry's line of BS, and what happens to the prisoners and their families who are auctioned off to be warehoused by these people with only a profit motive in mind.

PHOENIX - The nation faces tough questions in tough times, and there are people on both sides of every issue.

Arizona is no different. But who’s saying what about the issues important to Arizonans?

Each Sunday, ABC15.com debuts an Arizona issue - along with two opposing sides on the topic.

This week we're tackling the debate over the use of private prisons in Arizona.

After a much-publicized escape at a privately-operated prison in Kingman, the use of private facilities was called in to question and even became a divisive political issue for state officials .

Some say the use of private prisons saves taxpayer money and alleviates overcrowding issues at public prisons. They argue the use of privately run facilities is a boon to the economy and even helps provide jobs.

Others contend private prisons lack the security and oversight of public prisons and any savings passed on to taxpayers are greatly exaggerated. They say escape and safety concerns are serious issues continuing to plague privately-run facilities.

So, are private prisons necessary in Arizona?

CORRECTIONAL PARTNERSHIP PROVIDES THE BEST OF BOTH WORLDS: By Steve Owen, Corrections Corporation of America


A History of Partnership:

For many decades, governments at all levels have turned to the private sector to provide services once delivered exclusively by the public sector. Public-private partnerships are now prevalent in air traffic control, education, toll road operations, waste management and corrections.

Correctional partnerships have been an effective instrument in the “toolbox” of government for more than 25 years. Partnership corrections providers work with states like Arizona to combine the best of both worlds – the oversight and accountability of government with the efficiency and cost effectiveness of private business.

Opponents of public-private partnerships often resort to scare tactics, innuendo and character assassination in order to try to prevent partnerships. These campaigns are often fueled by big labor unions or ideology or in the case of Arizona – both.

Value of Correctional Partnerships as "Relief Valve" to Overcrowding:

Correctional partnerships are an innovative, common-sense approach: business and government working together to ensure taxpayers get the most out of every tax dollar, while providing fair, humane treatment for America’s prison population. That’s why state, federal, and local governments turn to businesses like CCA to build, manage and maintain partnership correctional facilities throughout the United States.

Partnership prisons offer governments an immediate “relief valve” to the number one problem facing prisons today – overcrowding. Overcrowding impairs the safety and security of hundreds of prisons across the U.S. and puts our families and communities at greater risk. Overcrowding also forces prison officials to utilize space intended for classrooms and gymnasiums to house inmates, which severely limits rehabilitative opportunities.

By relieving overcrowding, partnership prisons enable more inmates to receive rehabilitation programs they need to become productive citizens when they are released. In CCA partnership prisons, on a daily basis hundreds of CCA employees provide extensive drug and alcohol treatment, education classes and vocational training to inmates entrusted to our care by our government partners.

Accountability is Paramount:

The first responsibility of any correctional system is safety and security. Partnership corrections providers follow stringent rules established by their government partners and are expected by policy makers to meet or exceed services otherwise provided by government agencies.

Cost Savings to Taxpayers:

Partnership prisons save taxpayer dollars through efficient business practices and innovative prison designs and technology. CCA is able to save taxpayers money by using our national presence to buy more at better prices for many items such as prescription medications, staff uniforms, inmate clothing and security equipment.

Partnership prisons reflect state-of-the-art designs that maximize technology and ensure the most efficient operations possible. CCA continues to upgrade the quality of our correctional services while improving costs and constantly innovating the way in which we do business.

Strong Community Partnership:

In addition to helping governments meet their public safety responsibilities, partnership prisons also give communities an economic boost. A new correctional facility typically means hundreds of permanent careers, plus hundreds of initial construction jobs. In addition, businesses like CCA pay significant property and sales taxes for the partnership prisons we own and operate.

CCA in Arizona:

Opponents of public-private partnerships are using a combination of innuendo and scare tactics to spread misinformation about CCA and the Arizona immigration crisis. Here are the facts:

--Neither CCA nor any individual employed to represent CCA has on behalf of CCA directly or indirectly lobbied the governor or legislature regarding immigration law.

--CCA has never lobbied the governor or legislature regarding any state criminal law.

--Nearly 90% of CCA facilities are accredited by the American Correctional Association, which represents the nation’s highest correctional standards, with an average score of 99.3%.

--Security is why we exceed official government standards in every one of our prisons. Security is our Number One responsibility, and it is our Number One commitment.

--The economic benefits to the taxpayers of Arizona are equally clear:

In Pinal County, CCA pays approximately $7 million in annual property taxes.

In that community, our annual payroll is estimated to exceed $120 million and we contribute more than $8 million in yearly utilities.

CCA has over 2,700 employees in Arizona and has helped spur 1,700 spin-off jobs, paying over $200 million in wages annually.

CCA related activities generated more than $435 million in economic activity in Arizona in 2009 and produced a total of $26.2 million in tax revenue collected by governments statewide.

In summary, by combining the oversight and accountability of government with the efficiency and cost effectiveness of private business, partnership prisons are providing quality correctional services while ensuring that hard working taxpayers in Arizona and states around the country get the most of every tax dollar spent.

KINGMAN FOR-PROFIT ESCAPES: OPPORTUNITY FOR REASSESSMENT: By Frank Smith, Private Corrections Working Group


The deadly escapes from Management and Training Corporation’s (MTC) prison in Golden Valley, near Kingman, has briefly lifted corporate veils, providing the public with a narrow window on the dangerous and virtually uncontrolled operations of the for-profit industry’s Arizona facilities. The incidents were perhaps inevitable.

Inadequate staffing and training, failures of alarm systems and equipment and poor policies were the proximate cause, abetted by the abject failure of state monitors to address the obvious deficiencies.

The for-profit industry took advantage of a vacuum in Arizona’s regulations concerning their construction and operations. Beginning with three facilities in 1994, the industry rapidly imported prisoners to Arizona from across the nation. In Eloy and Florence they held District of Columbia and INS, Bureau of Prisons, and U.S. Marshal’s Service federal prisoners, as well as tribal prisoners. Exporters dumping many of their most violent felons included Washington, Alaska and Hawaii.

The prisons were insecure, often cheaply and inadequately built, staffed largely by poorly trained, poorly paid transients. They quickly experienced riots, sexual assaults of women prisoners and murders. Escapes abounded through the end of the decade, scattering fugitive murderers, rapists and other violent felons in Pinal County and beyond.

This was hardly unusual. Surveys going back to the advent of Arizona’s for-profits suggest that the escape ratio from private prisons nationally is about 30 times as high as from public facilities.

Before this escape, MTC experienced riots this year at its Arizona facilities, Marana and Kingman. Competitors had riots also. MTC founder Robert Marquardt claimed that Golden Valley was their “first major glitch.” A quick check revealed at least a dozen escapes, plus race riots and murders before 2010 in Texas, New Mexico, California and Utah.

Concerned with the lack of professionalism, Governor Janet Napolitano and Director of Corrections, Dora Schriro, resisted expansion of these prisons in the state, but the legislature refused to appropriate funds for expansion of the state system. Napolitano was forced to capitulate in 2003, allowing a facility to be constructed in Golden Valley, at first intended for DUI offenders, mostly minimum custody.

To deal with overcrowding, Arizona also exported prisoners, first to Texas, then Oklahoma, Colorado and Indiana. In each of these venues, riots precipitated by inedible food quickly followed as for-profits cut costs by hiring inept staff, providing little treatment, and flagrantly disregarding contractual terms.

Though crime was dropping, Arizona’s prison population was rapidly expanding.

The industry actually helped to manufacture that crisis. It lobbied for harsher sentences, tougher parole policies, even supported adding more crimes to the books. It did this especially through its criminal justice committee participation and chairmanships within the American Legislative Exchange Council, an organization to which a majority of the country’s conservative legislators belong. These gatherings produced “model legislation” to be brought back home - bills that assured the industry more prisoners, more market, and more market share.

Legislators holding critical posts continuously forced these irrational policies on states. It was hardly coincidence that in Arizona and elsewhere, a flood of campaign contributions went to sponsors of industry-favored bills. In Arizona, appropriations committee chairs such as Bob Burns and Russ Pearce were particularly willing to accommodate.

The proponents maintained this got the best bang for the taxpayers’ bucks. To the contrary however, an extensive study by Arizona in 2005 analyzed costs in 2003 and 2004. The for-profits actually cost 8.5% to 13.5% more than comparable state facilities. Subsequent studies further failed to verify any illusory “savings.”

By 2007, the industry had added five more Arizona facilities to the six it operated before 2000. The state contracted with some to provide alcohol and substance abuse “treatment.” In fact, inmates received little in the way of useful services.

Attempts by skeptical legislators to rein in industry abuses and lack of accountability were met by ferocious lobbying defeating such bills. This year Representative David Lujan’s bill to regulate their operations, establish an escape fund to cover liabilities, insure professional qualifications of employees and establish civil penalties for malfeasance, never got out of committee. A bill providing the same transparency of operations as required from public facilities, sponsored by Representatives Sinema, C.H. and C.L. Campbell, Meza, Patterson, Ableser and Cajero Bedford, met the same fate. This mirrored CCA’s federal success in particular of denying the public’s “right to know.”

A June 21st article published by In These Times, written by Beau Hodai, revealed relationships between the industry, Governor Brewer and the Republican majorities. Brewer’s campaign manager is CCA lobbyist Chuck Coughlin. Her chief spokesperson, Paul Senseman was CCA’s chief lobbyist. His wife continues the family tradition at the Policy Development Group. Public Policy Partners, holding GEO’s account, employs Richard Bark, an author of S.B.1070. He lobbies for the Arizona Chamber of Commerce, where CCA has a “board level” seat.

CCA also contributed $10,000 to the successful campaign to raise the regressive sales tax. More state revenues mean more possibilities for contracting out prisoners.

Brewer has attempted to create the illusion of distance between her and the industry. She has scrupulously avoided answering questions about this relationship in the primary.

In order to retain its lucrative contract, MTC has apparently fallen on its corporate sword, accepting responsibility for which liability must still be shared with the state.

Responses to requests by the media for Kingman monitors’ reports, that should have shown the shortcomings of security, have been inexplicably delayed.

On August 19th Coughlin made an appearance on Phoenix televison, ostensibly to explore the catastrophic administration failure to oversee MTC’s operation. Despite the clear record that Kingman was a Republican policy initiative, he first mendaciously tried to blame the failures on Napolitano and Schriro, then diverted discussion away to the tax bill.

Expanding the smokescreen, he began to blame entities that shared zero responsibility for the situation: The SEIU and UFCW unions, the boycott, the All Star Game, “President Obama’s electoral coalition,” immigration and “the left.”

The time for obfuscations is over. The public wants solutions. It wants them now.

Beware my anarchist friends - this has a real patriotic flavor, but it's a lot better than "America the Beautiful" or "The Star Spangled Banner", it recalls the truth of our collective history, and it puts the greedy racist pigs running Arizona to shame. It's also good to dance to, so rock on.

Brewer campaign cancels KPHO ads, attempts to discredit Loew.

Here's another recent clip from the Rachel Maddow Show covering the ties between Jan Brewer, private prisons, SB 1070 and the Brewer campaign effort to retaliate against Phoenix's KPHO and Morgan Loew for their investigative reporting on the issue. Brewer's people pulled all advertising from KPHO due to Loew's investigation of her CCA ties. Sounds like an attempt at censorship to me.

I've seen an awful lot of similar stuff across the rest of Arizona's media, however - can't imagine that Brewer can afford to pull advertising from all of them, or that she might expect to find someone who won't be critical of her if that's her criteria for where to advertise - maybe a FOX news affiliate?

Anyway, if KPHO won't be indoctrinating Arizona with any more Brewer ads, maybe that's where we should all be going for news...

White Supremacy, SB 1070, and Private Prisons in AZ

Hate Groups and Prison Profiteers Wrote Arizona's Juan Crow Law

Now, I suppose it is conceivable that white supremacists and the private prison industry could join forces in support of a good piece of legislation. After all, anything is possible.

But it sure isn't likely.

This is the situation we are seeing in Arizona with the passage of S.B. 1070, the anti-immigrant law that allows police to stop and arrest suspected undocumented aliens. Essentially, this law makes it a crime under state law to be in the U.S. illegally. The law allows police to stop anyone with a "reasonable suspicion" of being undocumented, and demand proof of citizenship. Those who cannot produce the documentation face arrest, a $2,500 fine, and 6 months in jail.

One must ask, where do they find these laws? Better yet, where do they find the people to write such laws? In searching for an answer, I turn to a colleague, the late Al Lewis. Yes, Grandpa from the Munsters. I knew him as a political activist and a radio show host when I worked at Pacifica Radio station WBAI ten years ago as a producer for Democracy Now! Al defined a law as "that which is bought and paid for." It was one of the most simple, yet profound statements I had heard. And it definitely applies to Arizona's S.B. 1070.

It is now no secret that two top level staffers in Gov. Jan Brewer's administration -- Paul Senseman and Chuck Coughlin -- have financial ties to the private prison industry, and stand to benefit personally from S.B. 1070. After all, private prisons lock up the immigration detainees in that state -- and they would like to run all of the prisons in Arizona, including death row -- so the new law is good for business. Senseman, the governor's deputy chief of staff, is a former lobbyist for Corrections Corporation of America, or CCA. And his wife presently is a lobbyist for the company. Meanwhile, Chuck Coughlin is one of the governor's policy advisers and her campaign chairman. Coughlin's firm, HighGround Public Affairs Consultants, currently lobbies for CCA. CCA and rival prison company Geo Group are members of the American Legislative Exchange Council, where they ensured passage of the insidious bill.

But it gets better, or worse depending on your point of view. State Senator Russell Pearce, who introduced S.B. 1070, has extensive financial ties to the private prison industry. He also has friendships with neo-Nazis such as J.T. Ready of the National Alliance, who calls Jews parasites, and hunts and kidnaps people on the border with Mexico. Ready once said "The truth is that negroids screw monkeys and rape babies in afreaka [sic]. Then stupid white man who licks kosher jew rear lets negroids in." And he once told a neo-Nazi rally that "This is a white, European homeland. That's how it should be preserved if we want to keep it clean, safe, and pure."

Senator Pearce has built his career on the backs of the Latino immigrant communities he has so fervently scapegoated. He has supported Nuremberg-style legislation that would prohibit hospitals from issuing birth certificates to children born of undocumented immigrants, and a law that would not allow people to marry without providing proof of U.S. citizenship and social security numbers. That would make it illegal for citizens to marry non-citizens! Pearce wants to eliminate the Fourteenth Amendment. And he supported the bill that has eliminated ethnic studies in Arizona public schools and colleges and universities.

And Senator Pearce has ties to the Federation for American Immigration Reform (FAIR). S.B. 1070 was written by Kris Kobach, a former Bush administration lawyer who now works for FAIR's legal arm. The organization has been designated by the Southern Poverty Law Center as a hate group. FAIR was founded by the nativist trailblazer John Tanton, who warned of the dangers of the "Latin onslaught" in America, and declared "for European-American society and culture to persist requires a European-American majority, and a clear one at that." And the group received $1.2 million from the Pioneer Fund, a racist eugenics foundation that funds studies linking race, genetics and intelligence.

For all of you conspiracy theorists out there, this is raw meat to be sure. But there's nothing theoretical about this conspiratorial scenario. Klannish hate groups and prison companies worked together to pass an atrocious, twisted and unconstitutional law. The former hates Latinos and thinks they are inferior, and would love nothing more than to throw them all behind bars for good. Meanwhile, the latter wants to profit from locking up as many immigrant detainees as possible. Just to top it off, both groups collaborated with their tools in the Arizona legislature and that horrid governor's office to make it all happen. This is Juan Crow in action. And sadly, it smells all too much like American history.

In fact, this reminds me of the days of Jim Crow, after slavery, when segregationist state and local governments enacted laws to maintain blacks in a state of virtual bondage. Laws targeted African-Americans specifically by going after offenses for which freedmen were presumed more likely to be charged, such as petty theft, vagrancy, burglary and bigamy. Under the convict lease system, an overwhelmingly black prison population provided free labor to the plantations, railroads and mining companies. "These companies assume charge of the convicts, work them as cheap labor and pay the states a handsome revenue for their labor.... The details of vice, cruelty and death thus fostered by the states whose treasuries are enriched thereby, equals anything from Siberia," said Frederick Douglass. "Every Negro so sentenced not only means able-bodied men to swell the state's number of slaves, but every Negro so convicted is thereby disfranchised." Of course, the ideological justification for the Jim Crow legal regime was that black people were inferior, and posed a racial, sexual, criminal, political and economic threat to whites.

And today, there is profit in prisons, with whole industries that make their bread and butter over the warehousing of warm bodies -including some of the prisons themselves. Roughly 70 percent of America's prisoners are black and brown because laws target communities of color. Yet, America's legal profession is among the nation's least diverse: Over 90 percent of the judges, prosecutors and defense attorneys are white. And law enforcement wages a racially-motivated war on drugs in poor black and Latino neighborhoods, with a financial incentive to maximize the arrests and convictions they win.

When racial scapegoats are conjured up--whether the black "crack babies" and "welfare queens" of the 1980s, or the Mexican "illegal aliens" and "anchor babies" of today--laws are created to legitimize the crimes that the state is about to commit against these groups, ostensibly in the name of the public good, but really for private profit. Sadly, in the land of the jobless and the hopeless, boogeymen are in great demand these days. And in Arizona, a group of greedy, unscrupulous folks got together with professional racists to criminalize the Latino community and make a buck at the same time.

SB 1070 Resistance Dancin' in the Streets!

This is long and a few days late (so I know I'm not stealing anyone's audience), but it's such a joyful Feathered Bastard that I still can't resist. There's a tune I've been listening to lately called "The Great Stone Wall" by Jim Page, that reminds me that things haven't always been so dark, so bitter, and so hateful on this planet as it seems to be here and now some days. We're so indoctrinated to the way things are that we fail to understand that things haven't always been this way - and its not the only way for them to be tomorrow, either. Ordinary people really can change the world.

Now, read on about the all night party outside of Sheriff Joe's jail while supporters waited for civil rights organizer Sal Reza to be released after his second arrest last week. And hit Stephen's blog (this week's is too funny) at the Phoenix New Times often for updates on what's happening in this place. Between the protests, parties, patrols, prisoners, people power (check out Guadalupe's resistance, too, folks), and my own personal battles (as well as the theft of my laptop from my home), I can't begin to tell you myself what's going on from day to day. So, I'm going to keep hitting up the New Times until they tell me to stop.


Enjoy the Feathered Bastard now, knowing that no matter what the mainstream media reports and pollsters tell you about popular opinion in Arizona, Sheriff Joe is eating a lot of crow these days - spoonfed by people of every age, color and creed. And PLEASE - regardless of anything else you hear, beg Natalie Merchant and all those superstars heading to the Dodge Theater this month to cancel their engagements - we need their moral support more than their money now more than ever. Tell them to come join the people dancing in the streets.

As civil rights leader Salvador Reza stood in stripes before a night court judge around 3:30 a.m. this morning at the Fourth Avenue Jail in downtown Phoenix, the county prosecutor made an eye-popping admission.

"This is really my review," he stated cautiously of a statement from the Maricopa County Sheriff's Office before him. "I did not see that this rose to the level of probable cause."

Reza's attorney Robert Pastor immediately pounced.

"Your honor," said Pastor, "I just heard the prosecutor tell the court that there's not enough evidence here to suggest that Mr. Reza committed a crime. I ask that the charge be dismissed and he be released immediately."

Of Reza's bogus charge for "obstructing a judicial proceeding," the judge herself seemed skeptical.

"I do not have enough information to find probable cause in this matter, sir," she told the county attorney.

She declined to dismiss the charge, but she released Reza on his own recognizance and set his next court date for August 18.

Reza, leader of the organization Puente, had been arrested late Friday afternoon after watching a band of protesters engage in civil disobedience by blocking Sheriff Joe Arpaio's command post for the MCSO's latest anti-immigrant sweep. The post was located near 35th Avenue and Lower Buckeye, close to the Lower Buckeye Jail. Reza was across the street in an unpaved parking lot.

Though Reza was not participating in civil disobedience that day, a pack of aggro sheriff's deputies ran across 35th Avenue and arrested him. Arpaio, MCSO Chief Brian Sands, and MCSO flack Brian Lee have all been videotaped stating that the arrest was because Reza had violated his order of release after he'd been let go on bond the night before for taking part in civil disobedience on July 29. This, as part of a "national day of non-compliance" to SB 1070.

After court was adjourned with Reza's O.R., a crowd of about sixty supporters, who had crammed into a viewing room to watch the proceedings from a TV monitor, erupted into applause. They then filed outside to wait another two hours-plus before Reza and the others arrested that day were set free.

The main entrance to the Fourth Avenue Jail had turned into an all-night block party for Reza supporters, with speakers blaring cumbia and protesters dancing in the middle of the street, sometimes in the pouring rain. At one point the crowd of Reza supporters numbered more than 100, and included numerous members of Unitarian Universalist Churches (referred to as "UUs") from across the country, who were in town to protest SB 1070 going into effect.

Sheriff's deputies and detention officers looked on from the roof, and from the corners of the building, but did nothing to stop the crowd. I asked one deputy why he and his compadres were seemingly okay with the revelry.

He simply shrugged and said, "It's a free country."

Pablo Alvarado, executive director of the National Day Laborer Organizing Network, was present in a parking lot with Reza as sheriff's deputies arrested the longtime anti-Arpaio activist. He said NDLON regarded Reza as a political prisoner, and that in the first two hours of putting up an online petition to "Free Sal Reza," NDLON had garnered 900 signers-on.

"They arrested him for no reason," he told me, as we all awaited Reza's release. "He was doing nothing. They just took him. To me it's clear that it's retaliation, because he's been highly critical of the sheriff. They [Arpaio and his staff] don't like him. They hate him."

Indeed, Reza has led several massive marches aimed directly at ending Arpaio's rule, as well as daily protests outside the Wells Fargo Building in downtown Phoenix, where Arpaio keeps two floors of pricey executive offices. Reza's Wells Fargo campaign ended with the bank asking Arpaio to leave, forcing the county to find another building for the MCSO, which Arpaio will likely move into sometime in 2011.

No one parties like a Unitarian...

When Reza finally emerged from jail Saturday morning, the sun was up, and his fellow activists were overjoyed to see him.

Reza said he was shocked by the arrest, which came without warning, just as he was about to leave for an interview.

"When I saw them coming, I thought they were coming for the people in the street," he explained. "But then they just passed them and went for me."

Regarding who actually ordered his arrest, Reza believes it was MCSO Deputy Chief Brian Sands, one of Arpaio's top henchmen, a man who looks like he would have felt right at home in the KGB.

"It was Sands," Reza contended. "Sands was in command."

MSCO thugs hustled a cuffed Reza to a van, where he remained for hours by himself. At one point, the MCSO opened up the van to display Reza to photographers and journalists like a captured prisoner of war.


"If they can do this to me," he told the reporters present before refusing interviews, "what do you expect they can do to anybody else."

Reza was transported to Fourth Avenue, booked, and forced to change into county stripes. As he was the night before, he was placed in solitary confinement. Reza said he was allowed no phone call, and there was no phone in the cell. He also stated that deputies never read him his Miranda rights.

I asked if he thought the MCSO was trying to break him.

"I think it's going to be a long time before they break me," he laughed. "I was ready to go eighteen days...that's when the court date is."

I wondered if he planned to sue the MCSO, as so many of Arpaio's victims have done, earning massive payouts from county coffers. Reza didn't say yea or nay.

"I just wish the [ U.S. Department of Justice] would get on the ball and do something about it," he replied. "I don't know what else they want...It's very clear."

The DOJ has been investigating Arpaio for more than a year now for civil rights violations. There's also a federal grand jury in Phoenix looking into Arpaio and the MCSO for criminal abuse of power.

Concerning the detention officers, Reza said he actually got along with some this time.

"Some of them are nice," he said. "Some of them, they basically don't like Arpaio."

This sentiment was echoed to some degree by Sarahi Uribe, a Yale graduate and organizer with NDLON, who'd been one of the protesters blocking sheriff's patrol cars from leaving for the sweep. She, too, was released on her own recognizance by the judge.

"One of the clerks or one of the officers inside slapped a message on the window [of the cell] that said, `By the way, what you guys are doing is awesome,' and walked away," Uribe told me.

Still, she was interrogated repeatedly by 287(g) officers in the jail, even though she's an American citizen. This, likely because she's not white and she initially refused to tell them her country of origin.

She also described "disgusting" conditions in the holding cell where she was kept with several other women. Uribe said women were sleeping on a floor littered with feces. Like Reza, she was never Mirandized.

Before he headed out to get some much needed rest, I asked Reza if he had any words for Sheriff Arpaio.

"Yeah," he said. "Come back to civilization."

Fat chance of that. They don't call it "Mari-Kafka County" for nothin'. For those of you reading who loathe Reza because of his politics, keep this in mind: There was no probable cause for his arrest. And if you want Arizona to resemble part of America, rather than a Third World junta, you should denounce his detention just as if you were one of his supporters.
